GENERAL CONDITIONS OF USE

These General Conditions of Use constitute a contractual relationship between You and Ibiza Community S.L., regarding the access to the platform and the use of the different services offered through the web site under the address Ibiza.com ("the Site" or "IBIZA.COM"), by the holder of the Site and/or third parties.

Access to and use of some services or products available at IBIZA.COM, may be subject to particular conditions governing the use that, depending on the individual case, shall complement, modify or replace the General Conditions of Use provided herein. In case of contradiction or exclusion, particular conditions shall prevail over general conditions.

USERS AND REGISTERED USERS

The mere access to Ibiza.com web implies the acceptance of these General Conditions of Use and confers the status of user.

The registration on the Site, by means of filling out the form and sending it by clicking on "Accept", confers the status of registered user and implies the acceptance of the present General Conditions of Use, as well as of the specific condition that may govern the serives provided to the registered users on the Web.

IBIZA.COM offers its users a great variety of products and services related to all types of trade in the island of Ibiza. To that effect, IBIZA.COM provides marketing and commercial intermediation services.

MINORS

Access to IBIZA.COM and, particularly, the use of its services is prohibited for minors under the age of 18.

IBIZA.COM may use certain authentication mechanisms aimed to verify the age of a particular user. IBIZA.COM provides users with a booking and offers search service in the tourism sector in the island of Ibiza. IBIZA.COM acts as an intermediary between the user and the provider of the service selected. Once the search is completed, the user may select the option of being transferred, by selecting the provided link, to the website of the selected vendor where the reservation may be made. The services of each provider are regulated by their own specific conditions of use/sale and privacy policy. Since IBIZA.COM is not responsible for the conditions of use or the privacy policy of the websites where the reservation is completed, the users are recommended to read them carefully before making any reservation.

IBIZA.COM does not collect any personal data related to the reservations made by the users, being their collection and processing the sole responsibility of the third party provider.

COMMUNICATION SERVICES

IBIZA.COM may contain social network services, including, but not limited to, instant messaging services, chat, users group, bulletin board system (BBS), discussion forums and any other service that allows users to communicate among each other in an interactive manner.

   -  Communicate, publish, send or share any content that could serve to collect third parties´ personal data, without prior consent of their holders;
   -  Upload files that contain virus, malicious software, faulty files or any software or element that could damage information system of the other or that could hinder or disable the correct performance and continuity of the service provided by IBIZA.COM;
   -  Upload files with a content that could violate third parties´ intellectual property rights;
   -  Communicate, publish, send or share any illegal, defamatory, racist, abusive, fraudulent, misleading information or content or that could be contrary to the law, morality or to the public order.

Content uploaded by the users of the communication services of IBIZA.COM is their ownership. In order for IBIZA.COM to be able to promote its platform and encourage contact and communication between the users and between the users and the collaborating companies, users grant to IBIZA.COM a free, non-exclusive, worldwide license to the uploaded content, all of the above under the terms set forth in the present General Conditions of Use, as well as in the specific conditions of particular services provided by IBIZA.COM. The duration of the license shall depend on the status of the profile of each user.

RIGHT OF EXCLUSION

IBIZA.COM reserves the right to withdraw or deny access to the Site, without prior notice, to those users who do not comply with the present General Conditions of Use or with the specific conditions established where appropriate.

INFRINGEMENT OF RIGHTS NOTICE

IBIZA.COM cares for the protection of the third parties´ rights. This is why IBIZA.COM has established a mechanism that allows the right holders to notify IBIZA.COM if they consider that their rights has been infringed on this Site, by sending an email to privacidad@ibiza.com, specifying the ownership and the right that they consider has been infringed, as well as the infringing content in order to be located and eliminated or modified, if appropriate, either directly by IBIZA.COM or by the infringer.

JURISDICTION AND APPLICABLE LAW

The present General Conditions of Use are governed by the laws of Spain. Any dispute that may arise from the application, compliance or interpretation of these conditions will be resolved by the Courts of the City of Ibiza.
